We had a strata SGM yesterday, and new Building Guidelines were voted in (preliminary copy attached). They are similar to the previous ones except removing some unintended changes introduced in 2019.
For the type of house predominant at Feathertop there should be no issue, and the attempt is to apply the guidelines with flexibility and pragmatism – but prevent repeating the few “odd ball” houses that have appeared.
We also amended a bylaw to:
5. Obtain approval before altering a strata lot
(1) Only one single-family dwelling may be constructed on each strata lot. Multi-family or duplex dwellings and prohibited. An owner must obtain the written approval of the strata corporation before making an alteration to a strata lot that involves any of the following:
(a) the structure of a building;
(b) the exterior of a building;
(c) chimneys, stairs, balconies or other things attached to the exterior of a building;
(d) doors, windows or skylights on the exterior of a building, or that front on the common property;
(e) fences, railings or similar structures that enclose a patio, balcony or yard;
(f) common property located within the boundaries of a strata lot;
(g) those parts of the strata lot which the strata corporation must insure under section 149 of the Act.
(h) preparation work for building on a strata lot, including:
(i) removal of trees
(ii) excavation
(iii) any alteration of grade on a strata lot including common property.
(2) The strata corporation must not unreasonably withhold its approval under subsection (1), but may require as a condition of its approval that the owner agree, in writing, to take responsibility for any expenses relating to the alteration.
The “idea” is to get an early heads up of new builds, and potential implications for the development. Your excavations were prior the rule, but it would be useful to “notify us” so we can try out the process of what we ask for, and advise you e.g. re the building guidelines process and approvals. For example we have other lots who have left the easements half dug up through the winter affecting ski-in/out.
Client confidentiality is of course understood, but before long the plans will have to go to RDKB and to the strata architect who deals with building guidelines approval.
